Terms of Use

1. Introduction
Welcome to homecarelink (the “Platform”), operated by Homecarelink Limited (“we”, “us”, or “our”), a company registered in New Zealand . These Terms of Use (“Terms”) govern your use of the Platform, which facilitates the connection between individuals or businesses offering services (“Service Providers”) and those seeking to purchase such services (“Customers”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Our role and liability
2.1 Service marketplace only
We provide a web-based platform that enables Service Providers and Customers to connect and enter into agreements with each other. We are not a party to any contract or arrangement between a Service Provider and a Customer. We do not act as an agent, employer, contractor, or guarantor for either party.
2.2 No liability for third-party conduct
We are not responsible for:
- the performance, quality, legality, safety, suitability, or reliability of services provided by Service Providers;
- the conduct or actions of any user of the Platform, whether online or offline;
- any disputes, claims, losses, injuries, or damages arising from or related to the use of services obtained through the Platform.
All arrangements entered into through the Platform are at your own risk.
3. Eligibility to use our Platform
To use the Platform, you must be at least 18 years old and legally capable of entering into binding contracts under New Zealand law. When you create an account, you agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Prohibited activities
You agree not to use the Platform to post, advertise, or promote any of the following:
- Sex work, escort services, or any services relating to brothels or commercial sexual services;
- Any unlawful, defamatory, obscene, harmful, or fraudulent content or services;
- Any activity that violates applicable New Zealand laws, including the Prostitution Reform Act 2003 and the Crimes Act 1961.
We reserve the right to remove any content or suspend/terminate any account that breaches this clause, at our sole discretion.
5. Homecarelink do not endorse or guarantee services advertised on our Platform
We do not endorse, recommend, or vouch for any Service Provider or Customer on the Platform. We make no guarantee as to the quality, timing, legality, or suitability of the services provided by users of the Platform. We do not conduct background checks or vet the qualifications of Service Providers unless explicitly stated.
6. Fees and Payments
We may charge Service Providers fees for using the Platform. Any such fees will be disclosed clearly and must be paid in accordance with our payment terms. Where Service Providers and Customers use integrated third-party payment systems (Stripe Connect), it is the responsibility of those parties to ensure that the details held by Stripe Connect are correct and sufficient for them to handle the transaction.
7. Intellectual property
All content and materials available on the Platform, including logos, text, graphics, and software, are our property or the property of our licensors. You may not use, copy, modify, or distribute any content from the Platform without our prior written consent.
8. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information in accordance with the Privacy Act 2020.
9. Termination
We may suspend or terminate your access to the Platform at any time and for any reason, including (without limitation):
- breach of these Terms;
- any conduct that we, in our sole discretion, consider to be obscene, offensive, defamatory, abusive, harassing, inappropriate, or otherwise inconsistent with the intended use and values of the Platform;
- behaviour that brings the Platform or its users into disrepute or creates a hostile environment for others;
- posting or promoting prohibited services or content, including sex work, escort services, or brothels.
We may remove any content you post on the Platform without notice if we consider it to breach these Terms or New Zealand law.
You may cancel your account at any time by following the instructions within your user settings. Upon termination (by you or us), your right to use the Platform will immediately cease, and we may delete your user content and account data in accordance with our Privacy Policy.
10. Appeals and review of decisions
If your account is suspended or terminated, or content you have posted is removed, you may request a review of the decision by contacting us in writing at appeals@homecarelink.co.nz within 7 calendar days of being notified of the action.
Your request must include:
- Your full name and registered email address;
- A clear explanation of why you believe the decision was incorrect or unjustified;
- Any relevant supporting evidence or context.
We will consider your request in good faith and may, at our sole discretion, uphold, reverse, or modify the decision. We are under no obligation to reinstate any account or content, and our decision on appeal shall be final. We reserve the right not to respond to requests that are vexatious, abusive, or lacking in merit.
11. Disclaimer
To the fullest extent permitted by law:
- The Platform is provided “as is” and “as available”, without any warranties of any kind, express or implied;
- We are not liable for any indirect, incidental, special, or consequential loss or damage arising out of your use of the Platform
12. Governing law and jurisdiction
These Terms are governed by the laws of New Zealand, and you submit to the exclusive jurisdiction of the courts of New Zealand in relation to any dispute arising under or in connection with these Terms.
13. Amendments
We may update these Terms from time to time by posting an updated version on the Platform. Continued use of the Platform following such changes constitutes your acceptance of the updated Terms.
